Eurasian patent

A Eurasian patent is issued by the Eurasian Patent Office (EAPO) on the basis of the Eurasian Patent Convention (EAPC),  whose members are 8 countries:

Russia,
Belarus,

Kazakhstan,
Turkmenistan,

Tajikistan,
Azerbaijan,

Kyrgyzstan,
Armenia.

A Eurasian patent can be obtained by filing an application either directly with the EAPO, or with the national patent office of an EAPC member state, or under a patent cooperation agreement (PCT).

 

To obtain a patent, an Eurasian application must be filed in any language, followed by a translation into the official language (Russian). At the same time, it is possible to establish the priority of one or more applications filed in any member state of the Paris Convention or the World Trade Organization, if the Eurasian application is filed within 12 months from the date of filing the previous application.

An international application filed in accordance with the PCT procedure is also treated as an Eurasian application filed on the filing date of the international application, while the term for transferring the international application to the regional phase in the EAPO is 31 months from the priority date.

Advantages of the procedure for obtaining an Eurasian patent compared to the procedure for obtaining national patents:

there is no need to take into account the peculiarities of the legislation of the EAPC member countries;

  there is no need to pay fees to each country in whose territory the protection of the invention is requested (only one procedural fee is paid for each action taken with the application);

  only one language of submitted documents is used (Russian);

paperwork on the application is carried out through one representative - an Eurasian patent attorney;

— The EAPO issues a single patent, which can then only be maintained in individual EAPC member states at the choice of the patent owner.
